1. Services of the web platform

(i) The web platform is developed and maintained byKEONICS. Solutions of KEONICS span the areas of ERP solutions, web portals, software development, and IT consultancy, IT training and networking. KEONICS provides theservice on behalf of its client, Animal Husbandry & Veterinary Services, Government of Karnataka. Services of this Portalcan be utilized by users to apply and receive animal transport permit/s. KEONICSthrough this portal provides the service on behalf of its Client Animal &HusbandryVeterinary Services, Government of Karnataka for communication and it is agreed that the permit charges will be charged on users for receiving permits.

(ii) The Portal is a platform that transporters utilize to apply for animal transport permits for transportation of livestock/animals within/from/to the state of Karnataka, India.

(iii) User acknowledges that KEONICS is only a Portal service provider and does not verify the bona fides and genuineness of the transport permit applications and KEONICS cannot and does not verify specific data provided by applicants. Therefore, KEONICS shall not in any manner be responsible or held accountable for any discord between the applicant and the authority

2. Eligibility of the User (as defined here in below)

(i) Use of the Website is available only to persons who can form legally binding contracts under the Indian Contract Act, 1872. Persons who are "incompetent to contract" within the meaning of the Indian Contract Act, 1872 including minors, un-discharged insolvents, etc., are not eligible to use the Website. If you are a minor i.e. under the age of 18 years, you shall not register as a member on this websiteand shall not transact directly or use the Website. KEONICS reserves the right to terminate your membership and / or refuse to provide you with access to the Website if it is brought to KEONICS's notice or if it is discovered that you are under the age of 18 years.

(ii) Organizational Campaigner / Legal Person's Registration: If you are registering as an Organization / Entity or generally as a Legal Person, not being a natural person, you represent that you are duly authorized by the Organization / Entity Management to accept these Terms of Use and you have the authority to bind the Organization / Entity to these Terms of Use.

3. Transporter

(i) An owner/driver of goods carrying vehicle / Light commercial goods vehicle / Heavy commercial goods vehicle is allowed to register his/her vehicle by uploading contact details, registration certificate and details, insurance and fitness certificate.

(ii) You shall ensure that the documents and/or information submitted/ disclosed by you to KEONICS in order to participate in the Scheme are at all times true, correct, up to date, and does not relate to any other person/entity besides the registered beneficiary.

(iii) Transporter is bound and legally liable to provide accurate, true and correct information in respect of the details of vehicles as well as transport application matters. In case of the data provided by the transport found to be wrong/false the transporter and related vehicle may be blacklisted

(iv) You further agree that by applying for permits on the Portal, you shall at all times abide by various laws applicable to You, as amended from time to time, including but not limited to Karnataka Prevention of Slaughter and Preservation of Cattle (Transportation of cattle) Rules, 2021, and central motor vehicle rules (eleventh amendment) 2015, as well as all applicable rules and regulations made under the respective laws.

(v) In order to develop and maintain the software, provide services on SaaS model on a consultant’s role, as per the work order from the Department of Animal Husbandry & Veterinary Services, Government of Karnataka,KEONICSreserves the right to charge an amount for the services provided to you. KEONICS reserves the right to utilize the funds in the manner it deems fit without any obligation to refund/pay it back under any circumstances.

4. User Account and Registration Obligations

(i) By using the Website, you shall be responsible for maintaining the confidentiality of your Login Name and Password, and you shall be responsible for all activities that occur under your Login Name. You agree that if any information provided by you that is inconsistent, inaccurate, not current or incomplete, or we have reasonable grounds to suspect that such information is inconsistent, inaccurate, not current or incomplete, or not in accordance with these Terms of Use, We reserve the right to indefinitely suspend or terminate or block access of your login access on the Portal and refuse you access to the application module.

5. Communications

(i) When you use the Portal or send emails or other data, information or communication to KEONICS, you agree and understand that You are communicating with KEONICS through electronic records and you consent to receive communications via electronic records from KEONICS periodically and as and when required. KEONICS may communicate with you by email or by such other mode of communication, electronic or otherwise.

(ii) Regarding the help/guidance/technical support or in case of grievances with respect to the using/usability or any issues occurred during the usage of the portal, you are supposed to contact the Helpline through phone calls/whatsapp/twitter or other means for the first level support.

6. Charges

(i) KEONICS does not charge any fee for browsing the Portal. KEONICS's charges are limited to the facilitation fee (registration fees and permit generation charges) which is charged to the transporters/permit applicants. KEONICS reserves the right to change its Fee Policy from time to time based on the approval and order of Department of Animal Husbandry & Veterinary Services, Government of Karnataka. In particular, KEONICSbased on instructions from the Department may introduce new services and modify some or all of the existing services offered on the Portal.

7. General Rules for the Use of the Website

You agree, undertake and confirm that your use of Website shall be strictly governed by the following binding principles: (i) You shall not host, display, upload, modify, publish, transmit, update or share any information which: • Belongs to another person and to which you do not have any right to; • Is grossly harmful, harassing, blasphemous, defamatory, obscene, pornographic, pedophilic, libelous, invasive of another's privacy, hateful, or racially, ethnically objectionable, disparaging, relating or encouraging money laundering or gambling, or otherwise unlawful in any manner whatsoever; or unlawfully threatening or unlawfully harassing including but not limited to "indecent representation of women" within the meaning of the Indecent Representation of Women (Prohibition) Act, 1986; • Is misleading in any way; • Is patently offensive to the online community, such as sexually explicit content, or content that promotes obscenity, pedophilia, racism, bigotry, hatred or physical harm of any kind against any group or individual; • Harasses or advocates harassment of another person; • Involves the transmission of "junk mail", "chain letters", or unsolicited mass mailing or "spamming"; • Promotes illegal activities or conduct that is abusive, threatening, obscene, defamatory or libelous; • Infringes upon or violates any third party's rights including, but not limited to, intellectual property rights, rights of privacy (including without limitation unauthorized disclosure of a person's name, email address, physical address or phone number),rights of publicity, or sale of counterfeit/stolen items; • Promotes an illegal or unauthorized copy of another person's copyrighted work, such as providing pirated computer programs or links to them, providing information to circumvent manufacture-installed copy-protect devices, or providing pirated music or links to pirated music files; • Contains restricted or password-only access pages, or hidden pages or images (including those not directly linked to or accessible from another page); • Tries to gain unauthorized access or exceeds the scope of authorized access to the Website or to profiles, blogs, communities, account information, bulletins, friend request, or other areas of the Website or solicits passwords or personal identifying information for commercial or unlawful purposes from other users

(ii) You shall not use any "deep-link", "page-scrape", "robot", "spider" or other automatic device, program, algorithm or methodology, or any similar or equivalent manual process, to access, acquire, copy or monitor any portion of the Website or any content, or in any way reproduce or circumvent the navigational structure or presentation of the Website or any content, to obtain or attempt to obtain any materials, documents or information through any means not purposely made available through the Portal. KEONICS reserves the right to bar any such activity.

(iii) You shall not attempt to gain unauthorized access to any portion or feature of the Website, or any other systems, server, computer, or networks connected to the Portal or to any of the Services offered on or through the Portal, by hacking, password "mining" or any other illegitimate means.

(iv) You shall not probe, scan or test the vulnerability of the Website or any network connected to the Website, nor breach the security or authentication measures on the Website or any network connected to the Website.

(v) You may not reverse look-up, trace or seek to trace any information on any other individual accessing the Portal, or of any other customer, including any account on the Website not owned by you, to its source, or exploit the Portal or any service or information made available or offered by or through the Portal, in any manner, including but not limited to reveal any personal identification or information, other than your own information, as provided for by the Portal.

(vi) You shall not make any negative, denigrating or defamatory statement(s) or comment(s) about KEONICS, or the brand name or domain name used by KEONICS, or otherwise engage in any conduct or action that might tarnish the image or reputation of KEONICS and The Department of Animal Husbandry & Veterinary Services, Government of Karnatakaon any platform, and/or otherwise tarnish or dilute any of KEONICS's trade or service marks, trade name and/or goodwill associated with such trade or service marks, trade name as may be owned or used by us.

(vii) You agree that you will not take any action that imposes an unreasonable or disproportionately large load on the infrastructure of the Portal or KEONICS systems or networks, or any systems or networks connected to KEONICS.

(ix) KEONICS shall have all the rights to take necessary action and claim damages that may occur due to your involvement/participation in any way on your own or through group/s of people, intentionally or unintentionally in DoS/DDoS (Distributed Denial of Services).

(x) KEONICS provides its services to you through its Portal, mobile applications and related services (collectively, such services, including any new features and applications, and the Site, the "Services"), subject to these Terms of Use (as amended from time to time, the "Terms of Use"). We reserve the right, at our sole discretion, to change or modify portions of these Terms of Use at any time. If we do this, we will notify you, either through the user interface (Website/mobile applications), in an email notification or through other reasonable means, and unless otherwise stated, KEONICS may communicate with you officially by any reasonable means now known or later developed. These currently include email, regular mail, and postings on the Portal. Any such changes will become effective no earlier than fourteen (14) days after they are posted, except that (i) changes addressing new functions of the Services or changes made for legal reasons will be effective immediately, and (ii) changes or modifications to the provisions therein. Your continued use of the Services after the date any such changes become effective constitutes your acceptance of the new Terms of Use. In addition, when using certain services, you will be subject to any additional terms applicable to such services that may be posted on the services from time to time, including, without limitation, the Privacy Policy. (i) Animal Husbandry and veterinary Services and KEONICS intents protection of your privacy as a very important principle. We understand clearly that you and your Personal Information is one of our most important assets. We store and process Your Information including any sensitive personal information or data collected (as defined under the Information Technology Act, 2000), if any, on computers that may be protected by physical as well as reasonable technological security measures and procedures in accordance with Information Technology Act 2000 and rules there under. 9.Disclaimer of Warranties and Liability

(i) This Website, all the materials and information and Services, included or otherwise made available to you through this site are provided on a "as is" and "as available" basis without any representation or warranties, express or implied except otherwise specified in writing. Without prejudice to the forgoing paragraph, KEONICS does not warrant that: • This Website will be constantly available, or available at all; or • The information on this Website is complete, true, accurate or non-misleading save and except as provided herein and which information is provided by the Campaigner themselves and none that which is provided or verified by KEONICS

(ii) KEONICS will not be liable to you in any way or in relation to the contents of, or use of, or otherwise in connection with, the Website. Nothing on the Website constitutes, or is meant to constitute, advice of any kind.

(iii) You will be required to register yourself by entering a valid phone number and e-mail address while applying for permits on the Website. By registering your phone number and e-mail address with us, you consent to be contacted by us and/or the AHVS authorities via phone calls and / or SMS notifications. We will not use your personal information to initiate any promotional phone calls or SMS unless the same is consented to by you. YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK. KEONICS AND ITS AFFILIATES EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. KEONICS AND ITS AFFILIATES MAKE NO WARRANTY THAT (I) THE SERVICE WILL MEET YOUR REQUIREMENTS, (II) THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, (III) THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICE WILL BE ACCURATE OR RELIABLE, OR (IV) THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION, OR OTHER MATERIAL PURCHASED OR OBTAINED BY YOU THROUGH THE SERVICE WILL MEET YOUR EXPECTATIONS.

KEONICS reserves the right, but has no obligation, to become involved in any way with disputes between you and any other user of the Services.

Also, you are willingly giving KEONICS permission to contact you via WhatsApp, Email, SMS, and other modes of communication.
